Leave Entitlement Deduction for Unpaid Hours
Employees on unpaid leave do not accrue any statutory entitlements such as Leave or Government Bonuses (Source: DIER - Frequently Asked Questions).
Similar to the calculation of Leave Entitlement for Part-Timers (with Variable Hours), when an employee on Fixed Hours has unpaid leave, their Leave Entitlement is decreased pro-rata to the unpaid hours. The amount of leave entitlement to be deducted is calculated using the following formula:
Unpaid hours ÷ 2080 hours x leave entitlement for the year
For instance, if a full-time employee takes 100 hours of unpaid leave, then we calculate the deduction as:
100 ÷ 2080 x 192 = 9.23 hours
Thus, 9.23 hours of leave must be deducted from their entitlement. Leaving the employee with, (192 - 9.23) = 182.77 hours of leave entitlement for the year.
Please note that such deduction does not apply when the employee is on unpaid sick, but only when the employee is on unpaid vacation or parental leave.
Public Holiday Entitlement during Unpaid Leave
If the employee is on any form of unpaid leave, they do not accrue public holiday entitlement. If the public holidays fall on non-scheduled days (e.g. Saturday) during a period in which the employee has unpaid leave, Buddy will not accrue the Saturday hours within the leave balance.
